Terms and Conditions & Acceptable Use Policy

These Terms and Conditions (“Terms”) govern your use of services provided by Thundergear Technologies Ltd (“Thundergear,” “we,” “our”), a company registered and operating in Mauritius at:
5th Floor, ICONEBENE, Rue de L’Institut, Ebene, Mauritius.

By using our website development, managed hosting, and related services, you agree to these Terms in full.


1. Scope of Services

Thundergear offers professional web design, website development, managed WordPress hosting, VPS hosting, domain name registration and management via third-party registrars, and related digital solutions. Additional services may include ecommerce integration, application development, technical support, and consultancy. Each service is governed by this Terms document and may have specific agreements defining scope, timelines, and deliverables.


2. Domain Registration and Management

Domains registered through Thundergear are handled by third-party registrars with ownership vested fully in the client. We operate registrar accounts on your behalf to manage DNS settings, renewals, and technical configurations. Domain ownership rights remain with the client at all times. Upon full payment and upon written request, we will transfer registrar credentials to the client.


3. Client Account and Security

Clients are responsible for providing accurate billing information and maintaining the confidentiality of login credentials. Immediate notification of any unauthorized access or security incidents to [email protected] is required. Thundergear reserves the right to suspend or terminate accounts in case of security breaches, fraudulent activity, or for any violation of these Terms.


4. Acceptable Use Policy

4.1 Prohibited Content

Clients shall not use Thundergear’s services to host, transmit, or distribute content or material that:

  • Contains pornography or adult content of any form (such violation results in immediate suspension).
  • Incites hate, violence, or discrimination against any group or individual.
  • Promotes terrorism, criminal activities, or unlawful conduct.
  • Infringes on intellectual property rights, data privacy, or confidentiality.
  • Contains phishing scams, malware, spam, or unauthorized advertising.
  • Facilitates illegal gambling, pyramid schemes, or fraudulent financial activities.
  • Engages in cryptocurrency mining, unauthorized file sharing, or torrenting activities.

4.2 Network and System Misuse

Use of our Services for:

  • Denial-of-Service (DoS) or Distributed Denial-of-Service (DDoS) attacks.
  • Network scanning, probing, or unauthorized access attempts.
  • Running mass mailing or spam campaigns.
  • Operating unauthorized proxies, VPNs, or relays.

is strictly prohibited. Such activities will result in immediate and automatic suspension of services and may be reported to competent authorities.

4.3 Email Hosting and Sending

Thundergear does not permit email hosting or outbound email sending using our servers. Clients must utilize their own SMTP servers or third-party email service providers.

Complaints regarding email abuse may be directed to [email protected] or through a support ticket at portal.thundergear.io. We reserve the right to suspend accounts at our sole discretion without prior notice, but with a written explanation. Clients will have 3 calendar days to resolve the issue upon notification.


5. Payments, Invoicing, and Project Holds

Payments may be made in Mauritian Rupees (MUR) or United States Dollars (USD). All invoices are payable according to the schedule defined in our online portal or any signed contract.

We reserve the right to hold or delay project deliverables and access if payments are not scheduled or received as agreed. Work will not proceed unless payments are up to date in accordance with the payment schedule. Recurring payments such as hosting fees or domain renewals must be settled timely to avoid service interruption.


6. Service Availability, Backups, and Data Security

We strive for 99% uptime on hosting services and perform regular automated backups. Clients are encouraged to maintain their own independent backups. Thundergear disclaims liability for data loss caused by client errors, negligence, or external malicious acts beyond our reasonable control.

Data stored on our servers is processed in accordance with security best practices. Although we are currently not fully compliant with Mauritius Data Protection Officer (DPO) obligations, we ensure data security and confidentiality per the Mauritius Data Protection Act 2017.


7. Intellectual Property Rights

Unless otherwise specified, all intellectual property rights to deliverables such as websites, source code, and designs remain with Thundergear until full payment is received. After full settlement, rights transfer to the client, except for underlying frameworks or third-party libraries, which remain owned by their licensors. Thundergear retains the right to showcase projects in portfolios or marketing.


8. Limitation of Liability

Thundergear’s total liability under these Terms shall not exceed the fees paid by the client for the specific service in the preceding 12 months. We disclaim liability for indirect, consequential damages, including lost profits, business interruption, data loss, or any special damages.


9. Suspension and Termination of Services

Services may be suspended or terminated immediately if a client:

  • Fails to pay fees within 14 days of the invoice due date.
  • Violates the Acceptable Use Policy or engages in malicious behavior.
  • Uses services contrary to applicable laws or regulations.

Voluntary termination requires 14 days’ written notice. Account suspension notices will include reasons, and clients have 3 days to comply before further actions.


10. Governing Law

These Terms are governed by the laws of the Republic of Mauritius. Any disputes arising out of or related to these Terms shall be resolved exclusively by the courts located in Port Louis, Mauritius.
